Terms and Conditions

These terms and conditions apply to all services provided by Minicab4You.  Please read these terms and conditions carefully before making a booking.  By making a booking you agree to be bound by these terms and conditions.

Please Note: A contract will exist between minicab4You and the passenger even if it is not recorded in writing and the same requirements apply even if the agreement is made orally.

Summary of Terms Used

 

These Conditions – any standard terms and conditions of sale set out in this document and includes any special terms and conditions agreed in writing between the Passenger and the Provider.

The Passenger – the person making the booking and any other person on whose behalf a booking was made.  By travelling in the vehicle each passenger is deemed to have accepted these Terms and Conditions. The booking must be made from the passenger rather than anyone else for example a driver.

The Provider – Minicab4You, The private Hire Operator Licence 4180.

The Contract – the contract for the provision of minicab services as defined in section 1.1

The Transportation Service – the minicab service to be supplied by The Provider in accordance with these terms and conditions.

 

 

 

Lawful Agreement

Lawful Agreement Under the Private Hire Vehicles (London) Act 1998 (the 1998 Act) a licensed operator who accepts a booking from a passenger is required to enter as principal into a contractual obligation with the passenger to provide the journey which is the subject of the booking.

Minicab4You Contractual Obligation

In order to comply with 1998 Act, Minicab4You confirms that we shall enter into a contractual obligation as principal with the person making the private hire booking to provide the journey, which is the subject of the booking, and any such contractual obligation must be consistent with the 1998 Act and these regulations.

Complying with the Obligation and Fulfilling our Responsibilities Minicab4You Confirms:

  1. We accept bookings from a passenger rather than anyone else for example a driver.
  2. We take responsibility for the journey from point A to Point B, rather than anyone else.
  3. All bookings are carried out in a London Licensed Private Hire Vehicle driven by a London Licensed driver.
  4. The booking is carried for the fare which was either agreed or for which an accurate estimate was provided.
  5. Fares are collected by Minicab4You or collected by the driver on behalf of Minicab4You.
  6. All complaints must be made directly to Minicab4You.

Full liability in relation to the transportation services belongs to Minicab4You.

Cancellations can only be carried out and confirmed by the Minicab4You and the booking passenger. Although a driver may reject an offer from the Operator to carry out a particular journey

1.1       A booking constitutes an offer by you to purchase The Transportation Service in accordance with these Terms and Conditions, and an acceptance by us to provide The Transportation Service.  A booking will only be deemed to have been accepted and hence a Contract entered when we confirm the booking by email, or when the journey commences, whichever occurs first.  At this point a Contract has been entered into between Minicab4You and the Passenger for the booking and the provision of the Transportation Service.

1.2     In order to comply with 1998 Act, Minicab4You confirms that we shall enter into a contractual obligation as principal with the person making the private hire booking to provide the journey which is the subject of the booking, and any such contractual obligation must be consistent with the 1998 Act and these regulations.

1.3       We are under no obligation to accept a booking, and a booking may be declined for any reason during the quotation request.

1.4       Once a booking has been accepted Minicab4You will be responsible for the provision of the Transportation Service.

1.5       By requesting a reservation on the Provider’s website (www.Minicab4You.com), by telephone, by email or by any other means the Passenger accepts these terms and conditions.

 

1.6       These Terms shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

  1. Quotations and Rates

 

2.1       The booking is carried for the fare which was either agreed during booking or for which an accurate estimate was provided.

2.2       Where the Provider has quoted a price for Service other than the price in the Provider’s published price list the price quoted shall be valid for 24 hours, or such other time as specified by the Provider.

  1. General Terms of Carriage

 

3.1       It is the responsibility of the Passenger to ensure that they have allowed adequate time for their journey.  Any recommendations or suggestions made by the Provider, or their staff, is provided solely to the best of their knowledge. However, this will not result in any liability to the provider for the journey time and will always remain an estimated time.

3.2       Fares quoted are for the exact journey specified by the Passenger, any additional diversions, set downs or pickups by the passenger will incur a additional charge which will be quoted in advance prior to the diversion taking place.

3.3       The Provider reserves the right to refuse any Passenger to make a journey if the passenger has excess luggage and have not notified the provider in advance, which would result in the vehicle being unsafe.

3.4       The number of persons and quantity of luggage must be specified at the time of booking.  The Provider reserves the right to increase the fare if the number of passengers or amount of luggage would result in a larger vehicle being required to accommodate passengers and luggage safely.

3.5       The Provider will not carry any of the following, and reserves the right to add to this list at any time:

  • Explosives, firearms, flammables, etc
  • Fragile, breakable or temperature sensitive items
  • Cash, securities and negotiable papers
  • Hazardous items
  • Alcoholic beverages or anything containing alcohol
  • Illegal narcotics / drugs

3.6     Where an unaccompanied luggage is transported the Provider will try its best to deliver the luggage to the destination specified by the Passenger.  Where this is not possible, or where the driver cannot obtain a signature for delivery the driver may return the luggage to head office where storage and additional delivery costs may be incurred.

3.7     The Provider reserves the right to refuse to carry any Passenger who behaves in a disorderly, threatening or abusive manner

3.8     The Provider does not accept any responsibility for loss or damage to unattended luggage.  Passengers are always responsible for their own luggage.  Drivers may, at their discretion, assist with loading and unloading luggage but this is solely at the Passengers risk.

  1. Standard Waiting Times and Additional Charges

 

4.1       Waiting time for all meets apart from airport pickups will be free for the first 5 minutes.  Thereafter waiting will be charged at a rate of £18 per 60 minutes.  For airport pickups the first 1 hours waiting time after your selected pickup time will be free of charge.  Thereafter waiting time will be charge at £18 per 60 minutes.  Flight delays will not incur waiting time charges, we will track your flight and update your pickup time according to the flight landing time.

4.2       Journeys which pass the through the London Congestion Zone and are not travelling directly to their destination may incur a surcharge of £15 on top of the fares displayed on our website.  This will be included in any quotation received directly from the Provider by email or telephone.

4.3       Reservations made on the following dates will be subject to a surcharge of 50% on published prices 25,31 December and 1 January

4.4       The Passenger will be charged a valeting fee of £60 for any damage to the vehicle including but not limited to vomiting, spilling liquid or food in the vehicle.

  1. Cancellations

 

5.1       Minicab4You is contracted for the provisions of the Transportation Service and all cancellations must be made directly with Minicab4You.

5.2       Any cancellations made within 24 hours of the journey time must be cancelled by phone by calling 02076133333.

5.3       For cancellations made 24 hours or more before the journey time a full refund will be issued.

5.4       Any cancellations made less than 24 hours before the journey time a cancellation charge of 100% of the full fare will be levied.

5.5       Any claim for a refund must be made within 1 week of the journey date.  A claim will be deemed to have been made when you cancel your reservation.

5.6       If the Passenger does not show up for the Transportation Service the booking will be treated as a “no-show” and 100% of the fare will be charged

5.7       If you cannot locate your driver and seek an alternative method of transport without first contacting the Provider to try and resolve the situation you will be charged the full fare for the booking.

  1. Payments

6.1       Minicab4You accept payments by most major debit/credit cards or by SumUp Services.

6.2       If payment in cash has been pre-authorised by Minicab4You, payment must be made to your driver who will collect payment on behalf of Minicab4You.
